The Assistance publique-Hôpitaux de Paris (AP-HP) indicated on Saturday that it had "modified" the sanction initially imposed against a nurse who refused to remove her surgical cap, following the court decision in early January that deemed her dismissal "disproportionate".

"The interim ruling acknowledged the fault but deemed the sanction disproportionate; it has been modified," a spokesperson for AP-HP told AFP, confirming the eight-month suspension handed down to the nurse and revealed by Mediapart.

According to Blandine Chauvel, elected representative of the Sud Santé staff, Majdouline B. received a letter "at the beginning of the week" announcing this sanction for repeatedly wearing a head covering in her workplace and refusing to remove it.

"The judge in chambers had ordered the reinstatement of my client, the AP-HP never did so and issued a new exclusion," lamented Majdouline B.'s lawyer, Lionel Crusoé, to AFP.

Majdouline B., a nurse at the Pitié-Salpétrière in Paris since 2018, was dismissed on November 10, 2025, with management accusing her of wearing a cap daily and in all circumstances, a fabric protective equipment usually worn in the operating room or in intensive care.

According to her lawyer, the caregiver never claimed any religious affiliation, simply stating that wearing this equipment was a matter of "her private life".

Seized in summary proceedings by the nurse, the Paris administrative court had suspended the dismissal decision in early January, pending a substantive examination, and ordered her reinstatement to her position "within a period of one month".

In his order, the judge in chambers considered that the nurse had indeed "committed a fault of a nature to justify a disciplinary sanction" but had on the other hand considered that there could be a "lack of proportion" between the fault committed and the sanction.

Following this decision, the AP-HP indicated that it "took note" and announced that it would adapt "its sanction decision to guarantee its proportionality in relation to the fault found".
